Cauda equina syndrome and your rights after medical error

On Behalf of Strauss Law Offices, LLC | Oct 16, 2025 | Medical Errors

A rare but serious condition, cauda equina syndrome (CES) affects the bundle of nerves at the base of the spinal cord. When these nerves become compressed, patients often experience severe back pain, numbness, bladder or bowel dysfunction and even permanent paralysis.

Timely diagnosis and treatment, including potential surgical decompression, are critical to prevent lasting damage. Unfortunately, when medical professionals fail to recognize CES symptoms or delay intervention, the consequences can be life-altering.

If you or a loved one suffered harm due to delayed diagnosis or treatment, understanding your legal options can be an important step toward healing.

Medical negligence in CES cases

Cauda equina syndrome may be rare, but the condition is well-known enough that medical providers should be able to recognize its hallmark symptoms. These can include:

  • Severe lower back pain, often radiating to the legs
  • Sciatica-like leg pain, numbness or tingling
  • Saddle anesthesia – loss of sensation in the buttocks, inner thighs and perineal area
  • Urinary dysfunction, including retention or incontinence
  • Fecal incontinence or constipation
  • Sexual dysfunction, such as loss of sensation or erectile issues
  • Leg weakness or difficulty walking
  • Loss of sensation or motor control in the lower extremities

When a provider fails to order appropriate imaging, misinterprets test results or dismisses these symptoms, it can delay treatment and worsen outcomes. Victims may be entitled to compensation if negligence directly caused or exacerbated their condition.

What to expect in a malpractice claim

A successful medical malpractice claim typically requires expert medical testimony, detailed treatment records and evidence of provider negligence. Damages for those harmed by malpractice may include compensation for pain and suffering, lost wages and future medical expenses.

You have only two years to file a medical malpractice claim in New Jersey, making timely legal guidance essential.
