What is Malpractice?

There are many news stories about malpractice suits and multi-million dollar payouts. However, this brings up the question, how do you determine if you are the victim of malpractice?

The first criteria is to determine the extent of the injury. Without a serious injury, even if mal practice was involved, it is not practical to pursue the case. However, even if there is a ‘negative outcome’ of epic proportions, it still does not prove that malpractice was involved.

For malpractice to be the proven, evidence must be identified that a healthcare professional was negligent and departed from basic ‘standards of care’ and that departure was the cause of the serious injury.

While this makes it sound very straight forward, in reality there are always many details that need to be reviewed. And keep in mind, it is possible to have a major ‘negative outcome’ and the history will show that no malpractice was in evidence. The only way you can truly evaluate a malpractice case is to have a consultation and review all the medical records.
